Morocco Private School Fee Notice: Publish and Prove

If a parent says nobody told them about next year’s fees, can you show who received your private school fee notice, and when? In Morocco, that question now has a legal frame. Law 59.21 requires a published fee list, bars any fee increase during the school year, and requires prior notice to guardians of any increase for the next year. The law gives no notice period and no required channel, so the practical job is a routine you can repeat: one fee list, one notice per family, and a record showing who received it. What Law 59.21 requires, and what is still pending

Law 59.21 was promulgated by Dahir 1.26.05 on 11 February 2026 and published in the Official Gazette (Bulletin Officiel n° 7485) on 23 February 2026 (SGG, BO 7485). The Chamber of Representatives had adopted it on 27 January 2026, with 45 votes for and 20 against (La Relève). Article 113 says the law enters into force on publication and repeals the former private-school statute, Law 06.00. It also says that provisions needing implementing texts take effect only once those texts are published.

That last clause splits the duties into two groups.

Fee publication and the in-year freeze. Article 49 contains no reference to a regulation for the fee list or the no-increase rule. On the text as published, it does not wait for a decree.

The written contract. Article 50 requires a written contract with guardians, a copy handed to them, and a copy kept in the learner’s file at the AREF’s disposal. The standard model contract is “set by regulation”. As of the latest reporting we found, the Ministry was still consulting on it: the model contract was a priority text among eight regulatory texts in April 2026 (Hespress, 22 April 2026), and no publication had been found by 10 July 2026 (Hespress, 10 July 2026). Check the Official Gazette for anything newer before you finalise your contract wording.

Tuition fees for 2026-2027: what the fee list must contain

Under Article 49, the list covers these items:

  • annual registration fees
  • annual insurance fees
  • monthly tuition, which must cover all educational activities
  • monthly charges for catering, boarding and school transport, where the school offers them

So bus and canteen fees belong on the list when you run those services. The school must announce the list at registration and re-registration, publish it permanently, post it in designated places in the school and, where applicable, use all available means, digital included. Digital publication is permitted, but the text does not say it replaces posting.

A reported draft of the model contract separated compulsory tuition from optional services such as transport and canteen (Akhbarona, May 2025). It is a draft, not the rule, but a list that already keeps those lines apart will be easy to adapt later.

A fee list you can publish this week

Picture a single A4 page and an identical web or app version, headed with the school year and a “valid from” date. One line per item, in dirhams: registration, insurance, monthly tuition, then bus and canteen if you offer them, each marked as monthly or annual. Add a version number and issue date at the foot. Every copy, whether on the notice board, the website or in a message, comes from the same file, so no family sees a different number.

Advance notice of a fee increase: the rule and a routine

Article 49 says fees may never be raised during the current school year, and that guardians must receive prior notice of any possible increase for the following year. It gives no number of days and no format. Everything below about timing and proof is recommended practice, not a legal requirement; we found no outcome data on notice routines, and the law does not state a fine for this breach, so we give none.

The in-year freeze

Treat the published list as locked from the first day of term to the last. If a cost changes mid-year, absorb it or hold the change for the next list. Do not add a new line item mid-year; put it on next year’s list.

The notice for next year

Send one notice per family in the first week of the spring term, before your re-registration window opens. Use the channel families already read, in French and Arabic, and put three things in it: the current monthly tuition, the proposed figure (or “no change”), and the date from which it applies. State that nothing changes this year. Keep it to under 150 words and attach the full fee list.

The written contract under Law 59.21

On its face, Article 50 requires a written contract. Because Article 113 delays provisions that need implementing texts, this duty may only bite once the model contract is published. Until the model appears, a sensible precaution is to write your own contract that reflects the fee list and the freeze, and to plan to align it once the decree appears. Hand each guardian a copy, and keep one in the learner file.

Add the fee list as an annex to the contract and write its version number into the contract, so the document the family signed and the list you published cannot drift apart. A family’s signed copy of the annex is also your strongest evidence of what they were told.

Article 51 adds that schools may not compel purchase of textbooks and supplies from the school (SGG, BO 7485), which is another reason to keep anything compulsory out of optional lines.

Choosing a channel: how to prove every family was told

These are the realistic options, compared on what each leaves behind.

The verdict: use two channels. Keep the posted list, because the law asks for it. Add one channel that records a per-family response. Paper with signed slips can do this, at a cost in teacher time; an app does it with less chasing. Whatever you choose, the test is the same: for every enrolled child, can you show which guardian received the notice and when?

Whatever you shortlist, ask each vendor for a written quote that states what translation and reminders cost.

Your routine, with dates

  1. This week: publish the 2026-2027 fee list on one page, version-numbered, posted in school and online.
  2. By the end of October: check that every enrolled child’s guardians have a working contact and are on your chosen channel.
  3. Autumn term: write or update your contract to attach the fee list, and check the Official Gazette for the model contract decree.
  4. First week of the spring term: send the next-year notice to every family and chase non-responses weekly until every household is accounted for.
  5. Before re-registration opens: keep whatever delivery record your channel produces (signed slips, acknowledgements) and file it with the learner files.
